1. Acceptance of Terms
By downloading, installing, or using the Vitara mobile application and related services (the "Service"), operated by Zynclave Tech Private Limited ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Vitara is a personal health and fitness tracking application that helps you monitor hydration, nutrition, workouts, and progress. The Service includes optional Cloud Sync with end-to-end encryption for cross-device data access.
3. Account Registration
- You may use Vitara without an account. Cloud Sync requires signing in with Google.
- You are responsible for maintaining the security of your account credentials and encryption passphrase.
- You must provide accurate information during registration.
- You must be at least 13 years old to use the Service.
4. User Data and Encryption
- All health and fitness data synced to the cloud is encrypted end-to-end on your device before transmission.
- You are solely responsible for remembering your encryption passphrase. We cannot recover your data if you lose it.
- You retain ownership of all data you create within the Service.
5. Subscriptions and In-App Purchases
Vitara offers a free tier and a premium tier ("Vitara Pro") unlocked through in-app purchase.
5.1 Plans Offered
- Vitara Pro Monthly — auto-renewing subscription billed every 1 month at US$6.99 (or local equivalent).
- Vitara Pro Annual — auto-renewing subscription billed every 12 months at US$49.99 (or local equivalent).
- Vitara Pro Lifetime — one-time, non-renewing purchase at US$149.99 (or local equivalent) granting lifetime access to the Vitara Pro tier for the currently available Service.
Vitara Pro unlocks Form Check (AI-guided exercise form analysis), adaptive coaching, smart nutrition (barcode scanning and catalog search), multi-device cloud sync, and all other features labeled Pro in the app. Free-tier features remain available without purchase.
5.2 Billing and Payment
- All purchases are processed by Apple (App Store / Apple ID) on iOS and iPadOS devices, and by Google (Google Play Billing) on Android devices. We do not receive or store your payment card, debit card, UPI, or banking information.
- Payment is charged to your Apple ID or Google Play account at purchase confirmation.
- Prices are displayed in your local currency inside the app at the time of purchase, and on the App Store / Play Store product pages.
5.3 Auto-Renewal of Subscriptions
- Monthly and Annual subscriptions automatically renew at the end of each billing period at the same price, unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage your subscription or turn off auto-renewal at any time in your Apple ID Subscriptions (Settings → your name → Subscriptions on iOS) or in Google Play Subscriptions (Play Store → Menu → Payments & subscriptions).
- Uninstalling the app does not cancel your subscription. You must cancel through your Apple ID or Google Play account.
5.4 Free Trials
If a free trial is offered for a subscription, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable. If you do not cancel before the trial ends, you will be charged for the subscription at the price disclosed at sign-up.
5.5 Lifetime Access
Vitara Pro Lifetime is a one-time, non-recurring purchase that grants continued access to the Vitara Pro feature set for as long as the Service is operated by us. Lifetime access is non-transferable and tied to the Apple ID or Google Play account used for the purchase. If the Service is permanently discontinued, lifetime access will cease; we will provide reasonable advance notice where possible.
5.6 Refunds and Cancellations
- Refund requests for App Store purchases are handled by Apple according to Apple's refund policy.
- Refund requests for Google Play purchases are handled by Google per Google Play's refund policies (48-hour auto-refund window for subscriptions, case-by-case thereafter).

5.7 Price Changes
We may change subscription prices for new purchases at any time. For existing auto-renewing subscriptions, any price change will be communicated in advance per Apple App Store and Google Play rules, and will take effect only at the next renewal. You may cancel before the renewal to avoid the new price.
5.8 Restoring Purchases
If you re-install the app or sign in on a new device, use the "Restore Purchases" option inside the Vitara paywall to re-associate prior purchases made on the same Apple ID or Google Play account.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Attempt to reverse engineer, decompile, or disassemble the Service.
- Interfere with or disrupt the Service or servers connected to it.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use automated systems (bots, scrapers) to access the Service.
- Attempt to circumvent, disable, or tamper with billing, entitlement, or subscription-verification mechanisms.
7. Health Disclaimer
Vitara is not a medical device and does not provide medical advice. The Service is intended for general fitness and wellness tracking only. Information provided by Vitara (including calorie calculations, hydration targets, BMI, and TDEE estimates) is for informational purposes only and should not be considered medical advice.
Always consult a qualified healthcare professional before starting any new exercise program, diet, or health regimen. If you experience any health concerns, seek medical attention immediately.
8. Intellectual Property
The Service, including its design, code, graphics, logos, and content, is owned by Zynclave Tech Private Limited and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
9. Availability and Modifications
- We strive to keep the Service available but do not guarantee uninterrupted access.
- We may modify, suspend, or discontinue any part of the Service at any time without prior notice.
- We may update these Terms from time to time. Continued use after changes constitutes acceptance.
10. Limitation of Liability
To the maximum extent permitted by law, Zynclave Tech Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or profits, arising from your use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
11. Indemnification
You agree to indemnify and hold harmless Zynclave Tech Private Limited and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your access to the Service at any time for violation of these Terms. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
